Welcome to Mochi ("the App"). Please read these Terms of Use carefully before installing, accessing, or using the App and its related services. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Scope of Application
- These Terms apply to the Mochi iOS application provided by Overio, including its focus timer, pixel pet growth, food items, map-based activity views, location-based nearby points, HealthKit step sync, notifications, and Live Activity features.
- Trial, beta, prototype, or test variants derived from the App are equally subject to these Terms.
- In the event of any inconsistency between these Terms and other notices, these Terms prevail. Supplementary terms issued for specific features form an integral part of these Terms.
2. Eligibility
- You must have full civil capacity under the laws of the People's Republic of China to use the App. Minors should use the App under the supervision of their legal guardians, who assume relevant responsibilities.
- You are responsible for ensuring that any information you provide in the App, such as a pet name or settings choices, is lawful, accurate, and appropriate.
3. Services
- The App offers gentle self-management features, including focus sessions, focus streaks, pet growth, feeding, activity feedback, walking-based progress, map views, discovery records, local notifications, and focus Live Activities.
- Step-related features may use Apple HealthKit after you grant permission. Location-based features may use your when-in-use location after you grant permission.
- Most App state is stored locally on your device. Some features depend on Apple system services, including HealthKit, Core Location, UserNotifications, ActivityKit, MapKit, and iOS settings.
- The App may be updated from time to time to improve performance, fix issues, or adjust feature behavior. Updates may lead to functional adjustments or changes.
4. User Conduct
- You agree to use the App lawfully and refrain from activities that violate laws, infringe the rights of others, compromise safety, or disrupt public order.
- You must not misuse location-based features, falsify activity data, manipulate device or system services, or attempt to obtain in-App benefits through improper means.
- You must not attempt to decompile, reverse engineer, tamper with, or bypass the App's security, persistence, permission, or activity-feedback mechanisms, except where such restrictions are prohibited by applicable law.
- You are responsible for safeguarding your device, Apple account, health permissions, location permissions, notification settings, and other system access controls.
5. Content and Intellectual Property
- You retain responsibility for any names, notes, settings choices, or other user-provided content you create in the App.
- You must ensure that your user-provided content does not infringe third-party intellectual property, privacy, portrait, reputation, or other lawful rights.
- All software, interfaces, artwork, icons, animations, interaction systems, algorithms, documentation, and other intellectual property embedded in the App belong to Overio or its licensors and may not be copied, modified, distributed, or used to create derivative works without permission.
6. Focus, Pet Growth, and Activity Feedback
- The App converts certain real-life actions, such as completing focus sessions and walking, into in-App feedback such as food items, pet progress, streak progress, map progress, nearby points, and discovery records.
- Food items, pet progress, streaks, map progress, and related records are motivational App features only. They have no monetary value, are not redeemable for money or property, and do not create any transferable right.
- The App may adjust activity-feedback rules, step goals, focus durations, map sections, nearby-point availability, food values, or other feature behavior from time to time.
- If local data is deleted, reset, corrupted, or unavailable due to device, system, storage, reinstall, or backup behavior, associated App progress may be lost.
7. Health, Fitness, and Safety
- Mochi is a lifestyle and companion app. It is not a medical device, health diagnosis service, treatment tool, or professional fitness coaching service.
- Step counts and activity-related feedback are for lightweight personal motivation only and should not be relied on for medical, health, safety, or professional decisions.
- You should exercise according to your own physical condition and local environment. Do not use the App in a way that distracts you while walking, running, commuting, crossing roads, or entering unsafe areas.
- If you have health concerns, consult qualified medical professionals before changing your exercise, sleep, focus, or lifestyle habits.
8. Location-Based Features
- Real-map features may show nearby points based on your current location when you grant location permission.
- Nearby points and related feedback are App-only elements. They do not indicate real-world goods, official points of interest, access permissions, or safe routes.
- You are solely responsible for obeying traffic rules, property rules, venue restrictions, and local laws when using location-based features.
- We may change, limit, suspend, or remove location-based features to improve safety, fairness, reliability, or compliance.
9. Fees and Third-Party Services
- The current version of the App is provided free of charge unless otherwise stated in the App or App Store listing.
- If premium features, subscriptions, purchases, cloud services, or paid content are introduced in the future, pricing, entitlements, renewal terms, cancellation methods, and refund policies will be clearly disclosed within the App or the relevant platform flow.
- When using Apple HealthKit, Core Location, MapKit, UserNotifications, ActivityKit, iCloud, App Store, or other third-party or platform services, you must review and comply with the relevant provider's terms.
10. Privacy and Data Protection
- The App may request access to HealthKit step count, when-in-use location, notifications, and Live Activities to provide its core features.
- App state, preferences, focus progress, pet progress, food item records, discovery records, map progress, and related data are stored on your device by default.
- We do not sell or rent your personal information. For additional details, please refer to the Privacy Policy.
- In case of conflict between the Privacy Policy and these Terms, the Privacy Policy prevails with respect to privacy matters.
11. Security and Service Interruptions
- You acknowledge that mobile applications may experience interruptions, inaccurate readings, delayed updates, permission failures, data loss, or reduced functionality due to device, operating system, sensor, HealthKit, location, notification, network, storage, or battery conditions.
- Please back up your device regularly if you want to preserve local App data through system backup mechanisms.
- If you discover bugs or security vulnerabilities, please notify us promptly. We will address them within a reasonable timeframe but cannot guarantee immediate resolution.
12. Disclaimer
- The App is provided on an "as is" and "as available" basis. We make no express or implied warranties regarding suitability, accuracy, reliability, stability, uninterrupted availability, compatibility with third-party services, or fitness for a particular purpose.
- We are not liable for losses caused by device failures, system restrictions, inaccurate HealthKit or location readings, permission changes, improper operation, network conditions, third-party services, or force majeure events.
- You bear sole responsibility for any risks or disputes arising from how you use focus, walking, location, notification, or other App features.
13. Limitation of Liability
- To the maximum extent permitted by law, Overio is not liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to lost profits, data loss, loss of goodwill, personal inconvenience, business interruption, or loss of expected in-App feedback.
- For direct damages attributable to our fault, our aggregate liability will not exceed the fees, if any, you have paid for the App in the twelve months before the claim arose.
14. Changes and Notifications
- We reserve the right to modify these Terms at any time. Updates may be announced via in-App notices, App Store release notes, or our official website.
- If you continue to use the App after an update, you are deemed to have accepted the revised Terms. If you disagree, you should cease using and uninstall the App.
15. Termination
- You may stop using and uninstall the App at any time.
- If you materially violate these Terms or applicable laws, we may restrict, suspend, or terminate your access to the App where technically and legally feasible.
- Upon termination, you remain bound by obligations that should survive under these Terms, including intellectual property protection, disclaimers, limitation of liability, and dispute resolution.
16. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the People's Republic of China, excluding conflict-of-law principles.
- Any disputes arising from these Terms or the use of the App shall be resolved through friendly negotiation. If negotiations fail, the dispute shall be submitted to the competent people's court where Overio is registered.
